An individual who has been convicted of a crime in California may appeal his or her case, and it is highly recommended that they retain an experienced appeals attorney as soon as possible.

The first step in addressing legal errors made during trial or sentencing, (adjudication or disposition in the case of a minor) is the filing of a "direct appeal."

In considering an appeal, the court reviewing the appeals case looks only at the "record" of the proceedings in the lower court, and does not consider any new evidence. The record is made up of the "Reporter's Transcript" of everything said at pretrial and trial proceedings, whether by the judge, the attorneys, or witnesses.

The appeals court also looks at the "Clerk's Transcript" which contains jury instructions, motions filed by the attorneys, the abstract of judgment, the jury's verdict forms, and any other pertinent documents.  Anything else admitted into evidence, such as documents or objects, also becomes part of the record.

In reaching a decision on the appeal, the appellate court looks to this record and to the written "briefs" filed by attorneys for both sides of the appeal case in which both sides argue their position on the questions raised in the appellant's opening brief.

Their positions must be supported by California case law.
