In California, the charge of driving under the influence is actually two charges:

  1. "Driving under the influence of drugs and/or alcohol" and

Consequences of Multiple DUI Convictions

Conviction for a DUI is "priorable" for at least ten years.

This means that if you are convicted of another DUI within that time, it will count as a second offense, resulting in mandatory jail time and a license suspension for at least one year.

Zero Tolerance in California for DUI

Beginning on January 1, 2009, drivers on probation for a DUI conviction face zero tolerance if they drive in California with a blood or breath alcohol concentration of .01% or higher.

If you are on probation for DUI and a police officer stops your vehicle, you must agree to take a preliminary alcohol screening (PAS) test, and if that test shows your blood alcohol content to be .01% or higher, your probation may be violated, resulting in the suspension of your driving privilege and a jail sentence.

If you drive while your license is suspended for a DUI conviction, the mandatory minimum jail term is 10 days, and an additional six months suspension of your driving privilege.  In some cases, your vehicle may also be confiscated.

DMV Proceedings
